Applicants who would normally not be eligible to become permanent residents of Canada may be able to apply on humanitarian and compassionate (H&C) grounds.
H&C grounds may apply to exceptional situations. Applications to become a permanent resident based on H&C grounds are assessed on a case-by-case basis. Usually the officers would see the following factors:
- The Applicant’s degree of settlement in Canada.
- Family Ties in Canada.
- Consequences that the Applicant might face on removal from Canada.
- Best Interest of the children involved.
